L'interpretazione del brevetto per invenzione

Abstract

La tesi, relativa all’interpretazione del brevetto per invenzione, è incentrata sulla determinazione del massimo ambito di tutela riconoscibile al brevetto attraverso l'interpretazione delle rivendicazioni non vincolata allo stretto senso letterale delle stesse. In questa prospettiva, nella tesi vengono trattati essenzialmente due temi: quello della tutela degli elementi equivalenti a quelli contemplati nelle rivendicazioni; e quello della riformulazione delle rivendicazioni. La trattazione è svolta tenendo conto della giurisprudenza e della dottrina italiane ed estere (Inghilterra, Germania, Francia, Olanda, Spagna, Austria, Svizzera e Stati Uniti).

The thesis, concerning the interpretation of the patent, focuses on the determination of the maximum scope of protection which may be attributed to a patent through an interpretation of the claims which is not bound to the strict literal sense of same. In this perspective, the thesis deals meanly with two themes: one is the protection of elements which are equivalent to those indicated in the claims; the other is the reformulation of the claims. This work has been drawn up taking into consideration the case law and legal theory of Italy and a series of other countries (the U.K., Germany, France, the Netherlands, Spain, Austria, Switzerland and the U.S.A.).
