dc.description.abstract | Il presente lavoro di ricerca ha come obiettivo quello di studiare il fenomeno dell’hate speech a partire da una prospettiva filosofico-giuridica come una questione di diritti umani. In particolare, dopo aver analizzato la questione della definizione di hate speech a partire dagli strumenti adottati nel diritto internazionale dei diritti umani, si propone uno studio teorico di due teorie della libertà (come non-interferenza e non-dominazione) che paiono soggiacere a due modelli di performatività, i quali a loro volta vengono delineati grazie agli strumenti forniti dalla teoria degli atti linguistici e della performatività, che permette di evidenziare due modalità di pensare alla relazione tra speech e action. L’applicazione dell’analisi teorica a questioni concrete trova spazio sia nell’analisi del di- battito sull’hate speech a partire dalla teoria della performatività e dalle due teorie della libertà analizzate, sia nello studio di due modelli giurisprudenziali che possono essere utilizzati come esempio di due diverse applicazioni della teoria della performatività al caso dell’hate speech. | it |
dc.description.abstract | Este trabajo de investigación tiene como objetivo el de estudiar la cuestión del hate speech a partir de una perspectiva filosófico-jurídica como una cuestión de derechos humanos. En particular, después de haber analizado el problema de la definición de hate speech en base a las convenciones adoptadas en el derecho internacional de los derechos humanos, se plantea un estudio teórico de dos teorías de la libertad (como no-interferencia y no-dominación) que parecen subyacer a dos modelos de performatividad, delineados gracias a las herramientas proporcionadas por la teoría de los actos de habla y de la performatividad, que permite subrayar la existencia de dos modalidades de pensar la relación entre speech y action. La aplicación del análisis teórico a cuestiones concretas se encuentra tanto en el análisis del debate sobre hate speech a partir de la teoría de la performatividad y de las dos teorías de la libertad, como en el estudio de dos modelos jurisprudenciales que pueden ser utilizados como ejemplo de dos distintas aplicaciones de la teoría de la performatividad al caso del hate speech. | it |
dc.description.abstract | This research aims at studying hate speech from a legal-philosophical standpoint as a human rights issue. After analysing the issue of the definition of hate speech under international human rights law, it suggests a theoretical framework based on two theories of freedom (as non-interference and non-domination) which appear to underlie two different understandings of performativity, analysed in turn through the tools of the theory of speech acts and performativity, which allows to highlight two different understandings of the relationship between speech and action. The application of the theoretical framework to concrete issues is found both in the analysis of the legal-philosophical debate on hate speech through the theory of performativity and the two theories of freedom analysed, and in the analysis of two case-law models serving as examples of two different applications of the theory of performativity to hate speech. | it |
