dc.description.abstract | Il principio di certezza del diritto, che si traduce nella ricerca costante di un diritto penale certo e prevedibile, è fondamentale in un sistema penale moderno. L'ordinamento statunitense utilizza tre diversi strumenti per cercare di ottenere un diritto penale stabile, certo e prevedibile: la void-for-vagueness doctrine, il principio di irretroattività (divieto di leggi ex post facto) e il vincolo del precedente (stare decisis). Nel presente lavoro, l'Autore analizza ciascuno di essi, con lo sguardo sempre rivolto al diritto penale italiano, per trarne una prospettiva diversa sul problema da un ordinamento che da sempre privilegia una prospettiva in action del diritto penale rispetto ad una puramente dottrinale. | it |
dc.description.abstract | The principle of certainty in the criminal law is fundamental in a modern legal system. The principle commands that the criminal law should be predictable, stable, and foreseeable. In the U.S. system, there are three instruments through which a higher degree of foreseeability and predictability is achieved in the realm of the criminal law: the void-for-vagueness doctrine, the prohibition of ex post facto laws, and the stare decisis doctrine. The Author analyzes each of them, with an eye to the Italian legal system, to draw a new perspective on the problem from a legal system, like the American one, which has always had a particular attention to the "in action" components of the criminal law, rather than just its theoretical aspects. | it |
